Terms of Use: MIND YOUR BUSINESS by Nitsan Raiter™

 


1. Terms

By purchasing “MIND YOUR BUSINESS by Nitsan Raiter™" (hereinafter “MIND YOUR BUSINESS” or “MYB” or “Course”), the purchaser (hereinafter “you” or “Customer”), agrees to be bound by these Terms of Use and willingly purchases entry into the Course for Two Hundred and Forty-seven US Dollars (US$247.00). The materials contained in “MIND YOUR BUSINESS by Nitsan Raiter™”, including without limitation, rights to view digital materials, videos and downloads, are protected by applicable copyright and trademark law. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

 


2. Use License

  1. Customer understands that MYB maintains all copyrights, licenses and other intellectual property rights to its original or derivative content associated with the Course, including but not limited to: videos, documents, charts, products, systems, processes, handouts, worksheets, copy for website or sales pages, and any other original work created by MYB, whether created prior to working with Customer or specially for customer.
  2. Permission is granted to Customer to temporarily download one copy of any downloadable materials on the MYB website for personal, non-commercial transitory viewing only. Customer understands that this is the grant of a license, not a transfer of title, and that the original proprietary rights remain with MYB. Nothing in this Agreement shall constitute a transfer of ownership or license of any Intellectual Property from MYB to Customer. Under this license Customer may not:
  3. modify, copy, edit, duplicate, repost, alter, publish, sell, assist in selling, distribute or explore the materials without the prior written permission by MYB, which permission MYB may unreasonably and arbitrarily withhold.
  4. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  5. attempt to decompile or reverse engineer any software contained on the MYB School’s web site;
  6. remove any copyright or other proprietary notations from the materials; or
  7. share the purchased material, information and content with others who have not purchased them, or 'mirror' the materials on any other server.
  8. Only the individual whose name is listed on the Course, has the right to view the Course videos, resources, Facebook group/s, and any and all material that is part of this Course program.
  9. MYB reserves the rights to remove anyone from the Course, and all of it's related groups, without a refund, for any behavior that MYB deems to be inappropriate, harmful or detrimental, to MYB or any student in this Course, without a refund and without a warning. Upon termination, Customer must destroy any downloaded materials in his/her possession whether in electronic or printed format. Transmission of MYB materials in any form or by any means, electronic, mechanical, photocopying, recording, or likewise, are prohibited.

 


3. Disclaimer

MYB’s materials are provided 'as is'. MYB makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.


MYB also does not make any guarantees or assurances regarding a particular financial outcome based on use of the Course, nor is MYB responsible for Customer earnings, or any increase or decrease in finances based upon information within or provided by MYB. Any information or testimonials regarding past or current Customers’ working with MYB contained on Website or in sales material that contain financial information are individual, and results may vary. MYB is not able to learn and assess all Customers’ businesses and strategies outside MYB and as such, have no way of ensuring that MYB will work or be applicable to all individuals or businesses. It is your job as the consumer to assess whether or not MYB will be right or beneficial for you, and is in no way the responsibility of MYB, or anyone else associated with MYB.


Customer understands that he/she is solely responsible for any outcome or results as well as fully responsible for his/her health well-being, and business decisions, including participation in MYB. MYB is not responsible nor liable to Customer should Customer sustain any injuries, incur harm, or encounter any negative ramifications. Individual results will always vary depending on individual capacity, work ethic, business skills and experience, level of motivation, diligence in applying this information, the economy, the normal and unforeseen risks of doing business, and other factors. 


Customer agrees that he/she does not have a right, cause of action, legal remedy, and is not entitled to a refund should he/she not achieve the results desired during or following completion or participation in the Course. Customer agrees to hold MYB harmless should any physical, emotional, or financial injury occur as a direct or indirect result of use of MYB.




4. Testimonials

Customer agrees and understands that MYB may publish Customer’s name and other identifying information on MYB website and social media should Customer choose to write about positive experiences in MYB. No payment or additional services will be provided in return for any such testimonial, and Customer understands he or she is granting MYB an unlimited, irrevocable license in perpetuity to use, publish, distribute, or repurpose any such written testimonial.



5. Payment

Customer understands the cost of the Course is payable in full at the time of purchase. Customer agrees to render payment via credit card on MYB sales and checkout page 

 


6. Refund Policy

Customer understands that the purchase of MYB is final sale 48 hours after purchase. Returns will only be considered if Customer has not completed more that two lessons. Customer is to conduct any and all necessary research to determine if MYB is right prior to purchasing.

 


7. Limitations

In no event shall MYB be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials, even if MYB or an authorized of the School has been notified orally or in writing of the possibility of such damage.

 


8. Non- Disclosure

Customer understands that one of the primary elements in purchasing MYB is the benefit of obtaining any or all of teachings, guidance and materials from MYB. Following Customer’s participation in this Course, Customer will have gained access to various trade secrets and strategies, personal intellectual property of MYB, including but not limited to materials such as verbal advice, written templates, modules, technical information, business advice, and/or other information that may have become available for use through Customer’s participation in MYB. Customer understands and acknowledges that this information is not to be shared with others who are not customers of MYB, without the prior written permission from MYB.

 


9. Revisions and Errata

MYB may make changes to the materials contained on its web site at any time without notice. MYB does not, however, make any commitment to update the materials.

 


10. Site Terms of Use Modifications

MYB may revise these Terms of Use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Use.

 


11. Indemnification

Customer agrees at all times to defend, fully indemnify and save harmless MYB and any affiliates, or other party associated with MYB from any demand, claim, causes of action, injury, illness, misunderstanding, damages, losses, costs, expenses incurred as a result of Customer’s use of Course, as well as any third-party claims of any kind (including legal fees on a full indemnity basis) arising from his/her actions as a direct or indirect result of Customer’s participation in Course.

 


12. Governing Law

This Agreement shall be governed by and under control of the laws of the Province of Ontario, Canada regardless of conflict of law principles, and regardless of location of Customer. Customer understands this and agrees that the laws of the Province of Ontario, Canada are to be applicable here.

 


13. Acknowledgement

 By completing the online purchase and being charged the amount listed above, Customer confirms he or she has reviewed these Terms of Use, completed any and all appropriate additional research, and asked any and all necessary questions of MYB in order to feel appropriately educated about the Course and product/service being offered. Customer understands he or she will not be entitled to a refund once completing this purchase for any reason.
